The trial version provides all the functionality of the FLAM(R) infrastructure without any warranty or support. (2) Unless expressly agreed otherwise, these license terms shall apply exclusively in the version valid at the time of the conclusion of the contract. (3) By installing the application with reference to the license terms or by otherwise setting up the software, the customer expressly agrees to the application of these license terms. Deviating provisions shall only apply if they have been agreed separately, expressly and in writing. If the customer does not agree to this, he must immediately notify the provider of this in writing. ## § 2 General (1) The Provider shall provide the Customer with the Software in the limited demo version. (2) The functionality of the demo version is limited to demonstration purposes. Use for commercial purposes is prohibited. The creation of files larger than 1 MB is prohibited. ## § 3 Third Party Software (1) To the extent that software products created by third parties are integrated within the scope of the software transfer and/or the provision of customization services, e.g. program libraries, parts of software tools and the like, the Customer shall receive the rights to these software products granted in the terms of use of the software products used, but at least a simple, non-exclusive right, limited to the term of the contract and non-transferable, to use these software products on its system. (2) The inclusion of software that is subject to open source licenses requires a separate agreement. In any case, the Provider shall only grant such rights of use to such software or other open source software that it is entitled to dispose of in accordance with the respective license. The Customer may acquire further rights of use to the open source components from the respective rights holders if it concludes license agreements with them under the terms of the respective open source licenses. In this case, the use of the open source components shall not be covered by the respective agreement or these license terms, but shall be governed solely by the respective open source licenses. If open source components are added or replaced in the course of providing maintenance, customization or update services, the terms and conditions set forth in these EULA for open source components shall apply accordingly. The list of open source components shall be adjusted in this case. The respective current list of OSS licenses used will be provided in the file 'LICAPX.txt' when downloading the Main Package. As far as from the respective open source license further information obligations (paragraph 4) arise, these are likewise fulfilled in the file. Furthermore, the respective current list of the OSS used can also be taken from the ABOUT functions and methods of the APIs and executables. In addition, the exchange of the external libraries is also described in the manuals and interface specifications in addition to the about texts. (3) Insofar as the subject matter of the contract merely relies on third party software or is capable of interacting with such software, such software shall not be the subject matter of performance and shall not be covered by the granting of rights under this contract. (4) The application uses third-party libraries which have been published under free software licenses. If necessary, these libraries are named with a prominent notice (about) in accordance with the requirements of the respective license. The license terms applicable to these external libraries are adhered to by the provider and are included with the delivery or made available as a download. (5) The software is not a work derived from the external libraries (no derivative work). All external libraries are used in unmodified form (a work that uses the library). If adaptations have been made, they have been published on [github](https://github.com/limes-datentechnik-gmbh/) in accordance with the respective licenses. All external libraries, which are part of the delivery, have been tested by the provider in the way they are used in the software and are in this combination in maintenance and support. They are thus part of the warranty (§ 9). \newpage (6) The user has the right to exchange certain libraries. Which libraries are affected by this and how this can be done is stored in the file 'LICAPX.txt'. If a library supplied by us is exchanged by the customer, the provider does not assume any warranty and no support services can be provided. The provider recommends to use the supplied versions of the libraries. ## § 4 Scope of delivery and restrictions of use of the demo version The demo version is for demonstration purposes only. The provider is entitled to limit the scope of performance of the demo license as desired. A compatibility with the purchase version is not guaranteed, in particular it cannot be guaranteed that the data generated with a demo version can be read correctly with a production version. Updates, upgrades, new releases or new versions are not part of the demo version. A claim to support services does not exist within the scope of the demo license. ## § 5 Granting of rights Unless otherwise provided for in § 3 of these license terms, the Provider grants the Customer a free, non-exclusive, irrevocable and non-transferable right, unlimited in time, to use the demo version of the software on its system for test purposes. Productive use for commercial purposes is prohibited. ## § 6 Duplication of the Software (1) The customer is entitled to copy the demo version if and insofar as this is necessary for the intended use. (2) The Customer's right to reproduce the Program Code under the conditions of Section 69d (1) UrhG shall remain unaffected. (3) Other reproductions are not permitted ## § 7 Modifications of the program; decompilation (1) The customer may not - unless an authorization arises from open source licenses - make any modifications to the program, unless these are necessary for the intended use. Reworking is permissible if it is necessary for the correction of a defect and the Provider is in default with the correction of the defect, the Provider refuses to correct the defect without justification or is unable to correct the defect immediately for other reasons attributable to its area of responsibility. Reworking is also permissible if it is necessary to remedy compatibility problems in the interaction of the program with other programs required by the customer, and the provider is not willing or able to remedy these for an appropriate remuneration customary in the market. (2) The Customer may not commission any third parties who are competitors of the Provider with measures pursuant to paragraph 1, unless the Customer proves that the risk of disclosure of important trade and business secrets of the Provider (in particular of functions and design of the Program) is excluded. (3) Decompilation of the program is only permitted if the prerequisites and conditions specified in Section 69e (1) UrhG are met. The information obtained in this way may not be used contrary to the requirements of § Section 69e (2) of the German Copyright Act (UrhG). Furthermore, the user may not carry out reverse engineering (tracing the computer program back to previous development stages, e.g. the source code, backward analysis, reverse development, decompiling, disassembling), no matter in what form and by what means. (4) Markings of the software, in particular copyright notices, trademarks, serial numbers or similar may not be removed, changed or made unrecognizable. ## § 8 Transfer of the demo license to third parties Passing on the demo version of the software or other materials to third parties is permitted and desired if this demo license is passed on at the same time. ## § 9 Warranty In the course of using the demo version, the liability of the provider is limited to intent and gross negligence. The liability according to the ProdHaftG remains unaffected.
